Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the websites backtoindependencerehab.com and bti‑rehab.com (collectively, the "Sites") and any related services provided by Back to Independence Rehab, LLC ("BTI Rehab," "we," "us" or "our"). By accessing or using the Sites or our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Sites or Services.

Description of Services

BTI Rehab provides adaptive fitness, aquatic therapy and occupational therapy programs for individuals with neurological impairments. The information on our Sites is for general informational purposes and does not constitute medical advice. Always consult a qualified healthcare professional before starting any therapy, exercise or fitness program. Participation in our programs may require completion of an intake assessment and signing additional consent forms. Services are provided at our facility located at 4801 Chastain Ave, Suite 194, Charlotte, NC 28217.

Eligibility and User Obligations

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to request services through our Sites. Parents or legal guardians may request information for minors but must accompany them for any consultation or therapy.

Accurate information: You agree to provide accurate, current and complete information when submitting inquiries or registration forms. You are responsible for ensuring that information you provide is up to date.

Compliance with laws: You agree to use the Sites only for lawful purposes and in a manner consistent with these Terms and all applicable laws.

No medical emergencies: Our Sites are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or seek emergency medical assistance immediately.

Payments

Fees for therapy sessions, fitness programs and other services will be provided to you before scheduling. Except as explicitly stated, payments are non‑refundable. We reserve the right to change prices for our services at any time, but price changes will not affect services already purchased.

Intellectual Property

All content on the Sites—including text, graphics, logos, images, audio clips, video, data compilations and software—is the property of BTI Rehab or its licensors and is protected by U.S. and international intellectual‑property laws. You may view, download and print content from the Sites for your personal, non‑commercial use only. You may not modify, reproduce, distribute, transmit, display, perform, publish, license or create derivative works from any content without our prior written consent.

SMS/Text Messaging Program

We may offer you the ability to receive text (SMS or MMS) messages from BTI Rehab for various purposes. By providing your mobile phone number and opting in to our messaging program, you agree to the following:

Description of SMS Use Cases

We may send text messages to:

Appointment reminders and scheduling updates — confirmations, rescheduling notices, and reminders for upcoming therapy or fitness sessions.

Program and service updates — notifications about facility closures, schedule changes, new program offerings or other important updates.

Marketing and promotional communications — announcements about special events, promotions, or wellness tips related to our services.

Opt‑Out Instructions and Support

Opt‑out: You may opt out of receiving SMS messages at any time by replying STOP to any of our messages. Upon receipt of your opt‑out request, we will promptly stop sending future text messages to your number.

Message Frequency and Fees

Message frequency may vary depending on your interactions with us and the number of appointments or services you engage in. Standard message and data rates may apply depending on your mobile carrier and plan. BTI Rehab is not responsible for any charges incurred from text messaging. Please check with your mobile carrier for details.

Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery of text messages depends on effective transmission by your mobile carrier and network operator.

Use of Mobile Numbers

Your mobile number will be used solely to deliver the types of messages described above. We will not sell or share your SMS consent or phone number with third parties for their own marketing purposes. We may share your number with service providers who assist us with text communications, but these providers are contractually obligated to keep your information confidential and to use it only to perform services on our behalf.

User‑Generated Content

If you post or submit any feedback, comments, photos or other content (collectively, "User Content"), you grant BTI Rehab a non‑exclusive, royalty‑free, worldwide, perpetual license to use, reproduce, modify, adapt, publish and display such User Content in connection with providing and promoting our services. You represent that you have the right to post the User Content and that your submission does not infringe any third‑party rights. We reserve the right to remove any User Content at our discretion.

Third‑Party Links

Our Sites may contain links to third‑party websites (for example, social media pages or external resources). These links are provided for convenience and do not signify endorsement. We are not responsible for the content or privacy practices of third‑party sites. Your use of third‑party sites is at your own risk and subject to those sites’ terms and policies.

Disclaimer of Warranties

The Sites and services are provided "as is" and "as available" without warranties of any kind, express or implied. BTI Rehab disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non‑infringement. We do not warrant that the Sites will be uninterrupted or error‑free, that defects will be corrected, or that the Sites or servers are free of viruses or other harmful components. Your use of the Sites is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, BTI Rehab and its owners, employees, contractors and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of the Sites, our services or SMS communications, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount you have paid to us for services in the six months preceding the claim (or, if no such payments have been made, $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability shall be limited to the extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless BTI Rehab and its affiliates, officers, agents and employees from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Sites, our services or SMS communications, your violation of these Terms, or your violation of any rights of another person or entity.

Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding relating to the Sites or these Terms must be brought in a state or federal court located in Mecklenburg County, North Carolina, and you consent to the jurisdiction of such courts.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will post the updated Terms on this page and revise the "Last Updated" date below. Your continued use of the Sites after the effective date of the updated Terms constitutes your acceptance of the changes.
